Big news for housing in Washington: Governor Bob Ferguson has signed HB 1096 into law, legalizing residential lot splitting across the state. After three years of advocacy, this landmark reform creates a straightforward, administrative process for homeowners and homebuilders to divide a single lot into two—unlocking small-scale infill, expanding homeownership, and creating new paths to affordability.

For decades, Washington law required homeowners and builders to navigate complex, costly subdivision processes that could take years—even when the existing lot already met zoning and infrastructure standards. HB 1096 finally fixes that, allowing qualifying lots to be split without major red tape, and enabling cities to review building permits alongside lot split applications.

Lot splitting won’t just create more homes—it will also allow aging homeowners to age in place, help families build wealth through multigenerational housing, increase opportunities for supplemental income, and offer first-time buyers access to starter homes in high-opportunity neighborhoods. It complements recent reforms like HB 1110 (middle housing) and supports the Growth Management Act’s goals by enabling gentle infill where it’s needed most.

HB 1096 ensures accountability by requiring clear, objective standards, displacement mitigation, and infrastructure availability before approval. Cities must implement the new policy by 2027 (or within two years for non-GMA jurisdictions), and guidance is expected from the state Department of Commerce later this year.

This is a major step toward restoring affordability and giving everyday Washingtonians more options to stay, build, and invest in their communities—one lot at a time.

Washington becomes the 11th state to adopt background check reform within the private sector. 

Today, June 7, marks the date the Fair Chance Act goes into effect in effort to ensure applicants are judged by their work and experience qualifications—and not by criminal or arrest histories. The act, HB 1298, is designed to get figurative feet in the door or, in other words, to keep companies from discriminating against potential hires until applicants at least meet minimum requirements for various job types. 

If an employer determines that the applicant is qualified, the law does not restrict the employer from inquiring into or obtaining information about a criminal record.

Maurice Emsellem, program director with the National Employment Law Project, says “HB 1298 represents a major step forward for Washington state’s business community and economy, while providing hope and opportunity to all those qualified workers who have struggled to find work with a conviction record but who are ready to give back to their communities.”

Penalties for not adhering to the act are as follows: 

• First Violation: Notice of violation.
• Second Violation: Penalty of up to $750.
• Third Violation and beyond: Penalty of up to $1,000 for each instance.

Forget your favorite tiny home hunter show for a minute—this is real life. Despite what the media tells us, homeowners and homebuilders, have only very recently begun to shrink their standards in favor of more compact confines.

In the 1990s, if you can remember back that far, about 23.2 percent of homes built were 3,000 square feet or more according to a builderonline.com article based on data taken from the Census Bureau American Housing Survey (AHS). But after the recession, square footage dropped, right? Not so much. The study, which looked at the years between 1990 and 2015, saw the number of 3,000-plus square foot homes built actually increase to 28.6 percent from 2010 to 2015. In fact, the tiny trend didn't really start picking up steam until mid-2016, when millennials and other such first-time buyers became a big enough segment to affect census numbers.

What's interesting is that the minor dent young folks and first-timers are putting in the overall evolution of expanse isn't enough yet to pull builders off course. As labor and land costs expand with our house sizes, builders are less likely to put themselves at risk, opting to operate in the higher-end housing market boasting secure returns, as opposed to taking a less calculated dip into the lower-end income pool and the smaller—dare we say ‘tiny'—household segment.

Does that mean lower-end shoppers are out of luck?

Not necessarily. Townhouse construction is on the rise, accounting for 9 percent of single-family homes from 2010-2015 (up from 6 percent during the ‘90s), and, according to the Builder article, recent data reports show townhouse construction making upwards of 12 percent of total construction in current quarters.

Will townhomes and tiny houses continue to creep into the bigger picture? Time will tell, but it's safe to say as costs continue to rise and people continue coming to hotspots like Seattle and the Puget Sound region, both builders and buyers will continue to push traditional housing boundaries and seek out less expensive, more practical means of housing.
