Washington becomes the 11th state to adopt background check reform within the private sector. 

Today, June 7, marks the date the Fair Chance Act goes into effect in effort to ensure applicants are judged by their work and experience qualifications—and not by criminal or arrest histories. The act, HB 1298, is designed to get figurative feet in the door or, in other words, to keep companies from discriminating against potential hires until applicants at least meet minimum requirements for various job types. 

If an employer determines that the applicant is qualified, the law does not restrict the employer from inquiring into or obtaining information about a criminal record.

Maurice Emsellem, program director with the National Employment Law Project, says “HB 1298 represents a major step forward for Washington state’s business community and economy, while providing hope and opportunity to all those qualified workers who have struggled to find work with a conviction record but who are ready to give back to their communities.”

Penalties for not adhering to the act are as follows: 

• First Violation: Notice of violation.
• Second Violation: Penalty of up to $750.
• Third Violation and beyond: Penalty of up to $1,000 for each instance.

Shannon Affholter Resigns as Executive Director of the Master Builders Association of King and Snohomish Counties

BELLEVUE, Wash—September 6, 2017—The Master Builders Association of King and Snohomish Counties (MBA) has announced the resignation of Shannon Affholter, the executive director since 2013. A recognized and effective regional leader for the MBA, Affholter leaves a successful and flourishing organization in place. Affholter's last day will be October 6.

"During the past four years, Shannon has done a remarkable job for our association," said Mike Walsh, the current MBA president. "Shannon and his staff have developed relationships throughout the region and the MBA is on the forefront and involved in critical community issues involving attainable housing, as well as essential planning for our region's continued growth. We have been fortunate to have a professional and dedicated executive like Shannon. His achievements both external and internal have been extraordinary and will provide a strong foundation for our future initiatives. We can't thank him enough for his work!"

Affholter made his announcement last week after accepting a position as Chief Operating Officer for Oakpointe Communities, one of the Pacific Northwest's premier land and commercial development companies. "While this is an exciting opportunity for my family and myself, I recognize the hard work and commitment required to help lead a company of this stature and size," said Affholter. "While it was a hard decision to leave the MBA, I understand that my success would not have been possible without the support of my staff and the latitude granted to me by the Executive Committee and Board of Directors. I will be forever indebted to both."

Mike Walsh will welcome Erich Armbruster in January as the 2018 MBA president and board leader. "Working closely with Mike, who has been instrumental in elevating the advocacy of our association, we must now focus our immediate attention on the responsibility of finding an executive leader with the right qualities to lead our organization," said Armbruster. "The MBA has a prestigious history, and while Shannon helped transition the association to another level, both Mike and I recognize how important it is for the future of our members and the Puget Sound Region to advance our ongoing presence and influence, while working constructively and jointly with other organizations to maintain the quality of life that we enjoy here in the Pacific Northwest."

COVID-19 Safety Toolkit Released for Construction Restart

Master Builders Association of King and Snohomish Counties develops a safety packet with templates for builders to resume work during COVID-19 crisis

BELLEVUE, Wash—April 24, 2020—Today, Governor Jay Inslee announced a plan to immediately restart some residential construction that can be done safely. The plan is based on recommendations unanimously agreed to by a workgroup formed by the Governor, consisting of construction industry and labor leaders. Based on the Governor’s announcement and this framework, MBAKS has created a safety toolkit designed to create and maintain a safe working environment upon return to construction projects.

“We have an obligation to help our workforce and our community stay safe as residential construction restarts,” said MBAKS Executive Director Kat Sims. “We are providing this toolkit simply because the safety of everyone who returns to work in this climate carries the highest importance.”

The Phase 1 toolkit includes safety plans for job sites—including policies regarding control measures related to safe distancing, hygiene, sanitation, etc.—and plans for jobsite cleaning and disinfecting, OSHA recordkeeping, and other safety information.

The toolkit also includes English- and Spanish-language signage and posters to be posted at job sites, and identifies specific duties given to onsite supervisors or managers who will oversee the compliance of safety protocols. Guidance on weekly meetings for procedures and expectations is included in the toolkit, along with daily checklists and safety data sheets.

MBAKS has created this toolkit alongside our existing COVID-19-dedicated website, which provides resources on where businesses can find safety equipment—PPE, handwashing stations, etc.—and resources pertaining to jurisdictions and utilities.
